The Committee on Derivatives and Futures Law focuses on legal and policy issues relating to exchange-traded and over-the-counter ("OTC") derivative instruments (e.g., futures contracts, commodity options, swaps, hybrid securities, and foreign exchange) and their related cash and forward contract transaction markets. The Committee focuses on the regulation of these markets and their participants (e.g. exchanges, OTC exempt commercial markets, clearing organizations, commercial market users, speculators, intermediaries, investment managers and hedge funds) by the Commodity Futures Trading Commission, the Securities and Exchange Commission, federal energy and banking regulators, international regulators, selfregulatory organizations, and state regulators. Topics include, among others, new legislation, regulations and interpretive releases, civil and criminal enforcement, private litigation, compliance policies and procedures, market structure and competition, and OTC contracting protocols, master agreements and other contracting issues.
