Thanks to the creation of the Synergy project, at the 2009 Annual Meeting the Real Estate Financing Subcommittee co-chaired a CLE program together with the ABA RPTE Real Estate Financing Committee. The program "It Seemed Like a Good Idea at the Time - Creative Financing for Troubled Times" featured a lively panel populated by BLS ComFin and RPTE committee members: Tim Boyce, Steve Davidson, Gib Masters and Norm Powell and moderated by Rod Clement. They reviewed current issues with the use of REMICs, mezzanine lending, tenant-in-common financing and Delaware statutory trusts in today's economy and prospects for using them in the future. We have uploaded the materials from that program and they can be found below.
Looking ahead, we are starting to plan for the Spring 2010 Business Law Section meeting in Denver. Last year we had a robust, structured discussion moderated by Ed Lester on the current real estate financing market (or lack thereof), and by the end of the meeting we were all certain of just two things: there was no easy solution and very few of us were closing or even working-out any real estate loans. Hopefully, we will not be singing the same tune next April. Our crystal balls have all seemed to cloud over and it is difficult to predict what will be relevant to our practices 7 weeks from now, let alone 7 months.
