This session will address the use of social engineering and new technologies to obtain personal information, including telephone records and financial information, under false pretenses. The session will highlight two particular methods, pretexting and caller-ID spoofing, and recent measures – including new federal legislation – designed to protect against such practices.

Against the backdrop of the 150-year anniversary of the Dred Scott decision, a panel of leading attorneys and legal historians will explore the significance and extraordinary role this historic decision has played in our legal system especially in the criminal justice system as new legislation strips federal courts of jurisdiction to hear petitions from detainees for writs of habeas corpus and the debate over property rights versus personal freedom continues.

Back to the Future: Forty Years of In Re Gault

The panel will focus on the Right to Counsel for defendants in juvenile delinquency cases, with a discussion of the 1967 Supreme Court decision in In re Gault, how that decision has been implemented, and its implications for the 21 st Century

The juvenile court has changed enormously in the last 40 years—indeed, the last decade has seen profound changes, as states have made the court more “adult-like” while preserving many aspects of the original model. Practitioners will emerge excited by the history of the historic Gault decision, and challenged by that decision’s implications in an age when the juvenile court is expected to be therapeutic, protect the public, compensate victims, and function in concert with principles of adolescent development.

Lawyers and judges interested in due process, the increasing complexities of juvenile court practice, and ethical issues in representation should attend.
