Model Rules for Lawyer Disciplinary Enforcement

I. Structure And Scope
Rule 5. Expenses

The salaries of disciplinary counsel and staff and their expenses shall be paid by the court out of the funds collected under the provisions of Rule 8. Costs and the expenses of the members of the board and of hearing committees shall be paid by the board out of the funds collected under the provisions of Rule 8. The board and disciplinary counsel shall annually obtain an independent audit by a certified public accountant of the funds entrusted to them and the disposition thereof and shall file a copy of the audit with this court.

Commentary
Disciplinary counsel and the board should be accountable for the expenditure of funds only to the court, except that unified bars may provide accounting and other financial services that do not impair the independence of disciplinary officials.
