Committee Activities

    The Privatization and Competitive Sourcing Committee meets monthly to discuss the latest developments and key legal issues that pertain to the privatization and outsourcing of the Federal Government's assets and activities to the private sector.  The Committee's monthly meetings often include presentations made by experts concerning recent developments and specific issues that arise in Federal Government privatization and outsourcing.

    The Committee took part in drafting comments submitted by the ABA Section of Public Contract Law to Representative Stephen Horn, Chairman, House Subcommittee on Government Management, Information, and Technology, on the then-draft "Competition in Contracting Act of 1998" which would have required agencies to list all non-inherently governmental activities that the agency performs, and subject those activities to public/private competitions.  More recently, the Committee submitted comments to the Office of Management and Budget concerning their implementation of the Federal Activities Inventory Reform Act, which requires Federal agencies to inventory and publish their commercial activities, and subject the inventories to administrative challenges by interested parties.  (Comments currently unavailable.) 

In addition, the Committee continues to monitor OMB Circular A-76 developments. The Committee, through the Section of Public Contract Law, recently commented on OMB Circular A-76 conflict of interest issues to Ms. Deidre Lee, Administrator of the Office of Federal Procurement Policy, and Mr. Stan Soloway, Deputy Under Secretary of Defense for Acquisition Reform, by letter dated February 10, 2000.
