Program Description
Learn how to woo the appellate court with specialized techniques.
In the final part of the Anatomy of an Appeal series, experienced appellate lawyers will discuss the art of appellate persuasion. Panelists will address the varied "audiences" to whom appellate lawyers advocate and how best to persuade them. They will distinguish between advocating to a trial court and an appellate court -- and why appellate counsel can be critical in both stages. Panelists will also share their experience on how to present an effective written brief and oral argument. Materials on effective appellate advocacy will also be available to attendees.
Program Faculty
Kendyl Hanks, is a senior associate in the Appellate Practice Group of Haynes and Boone, LLP in New York and Dallas, TX. Ms. Hanks provides traditional appellate services, in trial and on appeal, such as briefing and oral argument in cases involving business torts, commercial disputes, fiduciary duty claims, bankruptcy adversary proceedings, tax, constitutional law, jurisdiction, contributory fault; and proportionate responsibility and other complex substantive and procedural issues of law.
Dana C. Livingston, is a partner in the Austin office of the appellate boutique, Alexander Dubose & Townsend LLP. She is both a former Law Clerk for the United States Court of Appeals and a former Staff Attorney for the Supreme Court of Texas. Dana is a prolific writer and CLE speaker on appellate practice, particularly on federal appellate topics. Dana has been Board Certified in Civil Appellate Law by the Texas Board of Legal Specialization since 1995 and is the senior member of the Texas Board of Legal Specialization’s Civil Appellate Law Examination Commission, which is the committee that writes and grades the qualifying exam for civil appellate specialization in Texas. She also served as an Adjunct Professor Law at the University of Texas School of Law where she taught the Appellate Advocacy course for many years. Dana has been selected by Texas Monthly as a "Super Lawyer" in appellate practice, and she has been listed in The Best Lawyers in America in appellate law. Dana is the National Editor of and the Fifth Circuit author for a forthcoming nationwide appellate practice guide that will cover all states and all federal circuits and is being published in 2010 by the Council of Appellate Lawyers, which is part of the Judicial Division of the American Bar Association.
CLE Credit
1.0 hours of CLE credit in 60-minute states/1.2 hours of CLE credit in 50-minute states have been requested in states accrediting ABA teleconferences and live audio webcasts.*
NY-licensed attorneys: This non-transitional CLE program has been approved for experienced NY-licensed attorneys in accordance with the requirements of the New York State CLE Board for 1.0 total NY CLE credits.
