Program Description

Each year numerous protests are filed at the U.S. Government Accountability Office (GAO) and in the U.S. Court of Federal Claims concerning orders placed by government agencies under the General Services Administration's Federal Supply Schedules (FSS) Program.  In most cases, the issues are similar to those raised in other procurement protests.  However, there are some issues which are specific to FSS procurements. 

During this live teleconference and audio webcast participants will hear panelists from both GAO and the U.S. Court of Federal Claims, as well as several experienced members of the government contracts bar, discuss some of the most important issues and decisions impacting ordering agencies, vendors, and attorneys representing the parties in FSS protests. 

The expert panelists will explain recent case law and trends regarding what makes FSS protests different, including:

  • What is the standard of review for FSS protests?
  • Who can be an interested party?
  • Will FSS protests be decided as if FAR Part 15 rules apply?
  • Are FSS protests treated differently depending upon whether  there is a statement of work?
  • Does the ordering agency have to provide for full and open competition?
