Program Description

This group of experienced attorneys will address issues relating to dealing with acts of school violence with a particular emphasis on student mental health, mental disability issues, and privacy concerns.

Individual presenters will discuss the experiences of Virginia Tech  and Northern Illinois University in dealing with acts of violence on campus, the obligations of school districts under the provisions of the Individuals with Disabilities Education Act, and the limitations imposed by the IDEA when disciplinary action is being taken against disabled students.  Panelists will also discuss the challenges presented by compliance with the Family Educational Rights and Privacy Act and the Health Insurance Portability and Accountability Act when students are identified as individuals who present a potential threat to the school community or when an act of violence has been committed. Finally, legal counsel from Virginia Tech will share lessons learned and legislation adopted as a result of the shootings on the campus of Virginia Tech.
