Program Description
At the suggestion of the Department of Justice, the FAR Council has been supplementing the regulatory compliance obligations applicable to government contractors over the past 18 months.
A new final rule was issued in November 2007 that mandates the establishment of codes of conduct and business ethics by most government contractors. Such codes must facilitate timely discovery and disclosure of improper conduct in connection with government contracts and ensure that corrective measures are implemented as needed.
In December 2008 the FAR Council proposed to supplement that rule with a proposal to add a requirement that government contractors report overpayments and violations of the civil False Claims Act and violations of any criminal laws to the government, under penalty of suspension or debarment.
During this live teleconference and audio webcast, participants will hear panelists from the private sector government contracts bar and the U.S. Department of Justice discuss some of the most important issues impacting contractors and the government as a result of the new and proposed compliance rules.
The expert panelists will explain the concerns of the Department of Justice and the issues raised by the current proposal with regard to the attorney-client privilege, vagueness, enforceability, extraterritorial applicability, the impact on commercial item vendors, and other matters.
