Program Description

Pursuant to a non-discrimination mandate in Section 504 of the Rehabilitation Act of 1973, Housing and Urban Development has issued regulations governing construction and accessibility standards in federally assisted housing and vigorously monitors public housing authority’s (PHA) compliance with the standards. The panel will discuss:

  • Laws, regulations, and other HUD guidance regarding application of 504 to the construction and rehabilitation of federally assisted housing
  • One PHA’s experience with managing construction to 504 standards and then surviving a HUD review
  • Top to bottom third-party inspection and voluntary compliance agreements (VCAs)
  • "On-the-ground" experience of outside and in-house counsel managing HUD 504 reviews and VCAs as well as third-party litigation on accessibility
  • Interplay of 504 construction standards with other accessibility standards

The panel includes HUD experts, public housing authorities, for-profit and non-profit developers, and a PHA in-house ADA manager.

NY-licensed attorneys: This non-transitional CLE program has been approved for experienced NY-licensed attorneys in accordance with the requirements of the New York State CLE Board for 1.5 total NY CLE credits.
