Program Description
Most lawyers, like most people, try to avoid the inevitable: “Some day I’ll retire, but I don’t have to think about it now,” or “I’ll find a conservator next month.” We may plan to quit work but, like all phases of a career, a successful end requires sound planning. The time to start is now.
Based on chapters from the book, The Lawyer’s Guide to Buying, Selling, Merging and Closing a Law Practice, nationally known author and solo practice expert Jay Foonberg will focus on the major issues in selling and closing a law office and the three stages of: preparation, action, and what to do after the sale or closing. Topics will include:
- Who is going to do the work
- Client notification
- Preservation and destruction of files
- Protection of staff
In addition, Peter Geraghty, from the ABA Center for Professional Responsibility, will cover the ethical issues from the ABA Model Rules that guide the process, including:
- Significance of state variations
- Discussion of ABA Model Rule 1.17
- Ethical obligations of client files including notification and protection of client confidences
