Program Description

Many correctly view the March 2008 Supreme Court decision in Hall Street v. Mattel as a triumph of the Federal Arbitration Act over parties’ contract rights.  However, the many unresolved questions may still leave opportunities for counsel to expand the grounds of review of an arbitration award.  This teleconference will examine the limited but significant Hall Street holding and discuss how the Court’s acknowledged loopholes may undermine that holding. 

Topics include:

  • The Court’s majority decision and the dissents
  • How the decision affects parties’ contract rights
  • How the decision impacted—or did not—prior Court rulings on arbitration
  • What unresolved issues remain
  • How those future issues may be resolved
  • What other award review options parties have
  • Whether the decision is generally good or bad for arbitration
