Program Description
This teleconference and live audio webcast will explore the current development and expansion of arbitration, now one of the primary means of dispute resolution in the healthcare arena in the United States. Our expert faculty will focus on:
- The practical reasons for arbitration of healthcare-related disputes.
- The contractual nature of arbitration.
- The organizations that sponsor and administer arbitration.
- Methods of adopting private organization arbitration.
- Trends in federal and state court decisions upholding the enforceability of arbitration.
- Confirming the authority of arbitrators.
- Numerous drafting issues relating to arbitration provisions within contracts.
This program will help participants and is geared toward helping practitioners who draft contracts that may include arbitration provisions, practitioners who want to have a more complete understanding of arbitration provisions and agreements, and practitioners who inevitably will represent a client in arbitration to understand the basics of the arbitration process and how to maximize the opportunity to advocate a client’s position.
