Program Description
This program will address class certification practice points in the U.S., as well as differences among class actions in EU member states, U.S., and Canada. It will address issues principally from the perspective of antitrust actions, but the issues addressed will provide guidance on class certification and class actions generally. Professor Snyder will lead a discussion on what makes economic experts effective in U.S. litigation, focusing both on process and evidentiary issues affecting the outcomes of recently decided matters.
Our panelists will further discuss contrasts between the class action process in the U.S. and abroad, focusing on the certification process as well as strategic issues associated with simultaneous representation of clients in class actions in multiple jurisdictions. For example, in the EU, recently enacted laws require that claimants opt-in to collective actions, as opposed to the U.S., where typically claimants wishing not to participate in a class action must opt-out. In England, courts can issue group litigation orders, which provide for standardized centralized management of cases involving similar claimants. In Canada, requirements for certifying a class are arguably less stringent than in the U.S. regarding certain elements.
