Program Description

This program will assist law firms of all sizes in recognizing and avoiding the common ethics mistakes made in lawyer advertising. The panelists will cover such topics as internet blogs and referral service restrictions, key disclaimers for websites, tips for creating ethically appropriate infomercials, advertising in alternate realities, effective use of marketing directors, and national advertising campaign considerations.

Program Faculty

Michael Downey (moderator) is a partner at Hinshaw & Culbertson LLP and a member of the firm's Lawyers for the Profession® practice group. His practice focuses on helping lawyers, accountants, and their firms understand and comply with legal and ethical requirements through opinion letters, expert consultations, and defense of legal and disciplinary proceedings. Mr. Downey chairs the Ethics & Technology Committee in the ABA Center for Professional Responsibility. He also teaches legal ethics and law practice management at Washington University School of Law, serves on the Missouri Bar’s Special Committee on Lawyer Advertising, and helps write advisory ethics opinions for the Illinois State Bar Association.  

Diane Karpman is a legal ethics expert and has counseled lawyers and law firms for two decades. She is a past president of the Association of Professional Responsibility Lawyers, immediate past chair of the ABA/BNA Editorial Board for the Manual on Professional Responsibility, and an active member of the American Law Institute (ALI). She writes a monthly column, "Ethics Byte," for the California Bar Journal. An established authority in attorney ethics and standards of professional care, Ms. Karpman is frequently retained as an expert witness in legal malpractice and related proceedings.

Lynda C. Shely, of The Shely Firm, PC, provides ethics and risk management advice to lawyers and law firms. She also assists lawyers in responding to initial Bar charges. Prior to opening her own firm, she was the director of lawyer ethics for the State Bar of Arizona for 10 years. Ms. Shely is a frequent national speaker on professional responsibility, law firm risk management, and professionalism topics. She is a member of the ABA Center for Professional Responsibility’s Strategic Planning Committee and a Fellow of the American Bar Foundation.  She currently serves on the State Bar’s UPL Advisory Opinion Committee, the Professionalism Committee, and the State Bar Convention Committee. 

CLE Credit*

1.5 hours of CLE ETHICS credit in 60-minute states/1.8 hours of CLE ETHICS credit in 50-minute states have been requested in states accrediting ABA teleconferences and live audio webcasts.*

NY-licensed attorneys: This non-transitional CLE program has been approved for experienced NY-licensed attorneys in accordance with the requirements of the New York State CLE Board for 1.5 total NY CLE ECHICScredits.

The following states accept ABA teleconferences for mandatory CLE credit:
