After a year-and-a-half of experience under the amended Federal Rules of Civil Procedure, important trends have emerged in the discovery of electronically stored information (ESI).

This National Institute will bring together an all-star line-up of inside counsel, judges, e-discovery experts, and private practitioners for a full day of advanced-level programs that examine issues related to who is doing the work of e-discovery and its effects.

Such issues include:

• Whether who is doing the work affects how courts allocate the blame for mistakes
• The risks and benefits of downgrading data to backup tapes
• Cost-effective methods for handling the massive tasks of reviewing ESI
• The availability of discovery on e-discovery efforts
• The ethical issues that frequently arise
