The economic downturn has focused a lot of attention on big business. With companies declaring bankruptcy, or taking government money to stay afloat, business developments have been at the forefront of the news. But for-profit companies are only part of the story.
Most attorneys are also involved in a nonprofit in one way or another. If you do not represent them, you may serve on its Board. But how well do you know the legal pitfalls that can endanger a nonprofit? For example, the Internal Revenue Service (IRS) recently revised its Form 990 required annually of nonprofits, starting with the 2008 tax returns. The new form reveals an intense interest from the IRS in nonprofit governance policies. In addition, many state and city requirements and restrictions are subject to change.
The scope and complexity of laws governing nonprofits can take well-meaning lawyers by surprise. If attorneys are unaware of changes to laws governing nonprofits, they can face personal and professional liability.
