After 30 years, asbestos litigation has turned into perhaps the greatest single burden on civil courts in the United States today. How to eventually bring the flood of cases to a close in a way that rewards persons injured by contact with asbestos without over-burdening companies and insurers continues to bedevil the legal system, despite recent efforts in Congress and elsewhere to implement approaches to effectively meet those goals. The ABA has had a significant voice in the issue. The House of Delegates passed a series of recommendations on the issue in February at the association's midyear meeting. This article and teleconference will analyze the problems facing asbestos litigation, assess the proposals to address those problems and their chances of success, and explain what it all means for individual clients who have asbestos-related claims.
