A crucial question for lawyers who work in government at all levels, business lawyers, disaster relief organizations, regulators, and utilities and other public service providers is whether enough lessons were learned from Hurricane Katrina to assure a more effective response to regional or national catastrophes in the future. The conclusion of a subcommittee of the ABA's Hurricane Katrina Task Force is sobering. "The devastation wrought by Hurricane Katrina did not occur because laws were inadequate, the report concludes. Lack of adequate training and readiness, failure of various entities to ensure communications and coordination, delay from inaction and breakdown of leadership all contributed." A key question, states the subcommittee's report, is when and how the response to a disaster should shift from being primarily local to federal in nature. Another important question is what the role of the military should be. This article and teleconference will look at the issues raised by the subcommittee report in seeking to identify key legal and policy issues in responding to the next Katrina–or worse.
