Current Developments in Business Litigation

This program ties in with the recent Section of Litigation’s publication of the multi-volume, second edition of Business and Commercial Litigation in Federal Courts. Our faculty will highlight some of the rapidly evolving issues in business litigation that were practically nonexistent when the first edition was published in 1998 such as e-discovery, litigation technology, techniques for streamlining and expediting litigation, case evaluation, and civility.

Contingent fees continue to stir great controversy especially in class action cases, mass torts, and medical malpractice lawsuits.  The controversy most recently gained national attention when President Bush banned contingency fees in cases filed by the U.S Government.  Federal judges have called contingent fees “grotesque” and plaintiffs claim they will be denied access to the courts without them.
