Topic One: "Hatch-Waxman for Non-FDA Lawyers and Proposed Legislation Related to Hatch-Waxman and Drug Patent Settlements

The Health Care Industry Committee and the Intellectual Property Committee of the ABA Section of Antitrust Law are sponsoring a series of three brown bag seminars on antitrust issues arising from patent litigation settlements between brand name and generic drug manufacturers. This first brown bag seminar will provide an introduction to non-FDA lawyers to the exclusivity and patent protection provisions of the Hatch-Waxman Act. Speakers will also address proposed legislation to modify these provisions, as well as to impose a requirement that certain agreements between brand name and generic drug manufacturers must be filed with the antitrust agencies.
Subsequent brown bag seminars on 2/20 and 3/19 will address government enforcement initiatives and issues involving private litigation in connection with patent settlements between brand name and generic drug manufacturers.
