Section Launches APA Restatement Project

The Section has commenced an ambitious project to restate federal administrative law and to prepare proposals for reform. Viewing the state of the Administrative Procedure Act some fifty years after its creation inspired Section Chair Ron Cass to initiate the project, which is to be headed by former Section Chair and Cardozo Law School Dean Paul Verkuil as Chief Reporter (with Cardozo professors John Duffy and Michael Herz as his assistants). The Co-Reporters and their specific areas of concern are as follows:

Co-Reporters for Rulemaking: Thomas O. McGarity, University of Texas Austin School of Law; Peter L. Strauss, Columbia University School of Law

Co-Reporters for Adjudication: Michael R. Asimow, University of California at Los Angeles School of Law; Glen O. Robinson, University of Virginia School of Law

Co-Reporters for Judicial Review: Ernest Gellhorn, George Mason University School of Law; Richard L. Revesz, New York University School of Law

Co-Reporters for Openness: Richard B. Stewart, New York University School of Law; Tom Susman, Ropes & Gray

Co-Reporters for Government Management: William F. Funk, Lewis and Clark School of Law; Cass R. Sunstein, University of Chicago Law School

The Restatement project has a web site at Awww.abanet.org/adminlaw/apa/home.html.@ Once outlines are prepared, they will be posted on the site. After questions of format and scope are resolved, drafts of the various sub parts of the project will be posted on the web site and critiqued at forthcoming meetings of the Section. In addition, a program on the Restatement project=s activities will be presented at the Annual Meeting in Atlanta in August. Dean Verkuil urges all interested persons to participate in this extraordinary effort, which is expected to take two or three years to complete. The resulting product will both describe the field of federal administrative law and prescribe changes and improvements to it. It is anticipated that a comprehensive publication will result.
