On January 1, 1996, the Interstate Commerce Commission, established in 1888, the first
regulatory agency, the first "independent" agency, ceased to exist.
The 1995 Interstate Commerce Commission Termination Act transfers many of the ICC's still existing duties to a new independent agency within the Department of Transportation, the three-member Surface Transportation Board. Among the substantive changes to law are reduced protections for railroad employees when railroads are sold or merged, restrictions on the review of railroad mergers, and elimination of the need for railroads to file tariffs. The Act also creates a 15-member Rail and Shipper Transportation Advisory Council.
