From the Section Chair....           

As many of you already know, within the past few weeks the Section has lost two of its leaders, Council member Tom Sargentich, and former Section chair and member of the ABA House of Delegates, Ernie Gellhorn. They both cared deeply about improving the law and making our government work effectively for all of its citizens. They both always exhibited the highest standards of professionalism. And, as importantly, each was a wonderful colleague and friend to all in the Section privileged to know them.

Even while we mourn the loss of Ernie and Tom, we continue ahead with the activities of the Section to which both were so devoted. After enjoying a very successful first annual Administrative Law and Regulatory Practice Institute in early April and a stimulating and sociable Spring meeting in early May, we already have four new lunch programs scheduled in the next month. Please take a look at the program links below, along with our annual meeting plans in Chicago, our new book releases, and other activities.

I know we will miss both Tom Sargentich and Ernie Gellhorn greatly--but I also know they were proud of what we are accomplishing in the Ad Law Section, and that they would want us to do even more and to do it even better. Please join us in that endeavor.

Section Mourns Two Great Losses

With the untimely passing of Thomas Sargentich and Ernest Gellhorn, the Section lost two real leaders and true friends, both of whom made significant contributions to the Section, to the administrative law community, and to the American law profession. For a sense of their personal and professional contributions, please read the memorial resolutions in honor of the memories of Tom and Ernie.

 2005 Annual Meeting
 
The Annual Meeting of the Section will be held in conjunction with the ABA Annual Meeting in Chicago, Illinois over the dates of August 5-7, 2005.  The Section's host hotel is the Fairmont Chicago.
 
Important dates:  The early-bird registration deadline for the ABA Annual Meeting is May 27th.  After this date fees sharply increase. Register for the meeting now and save:

Award Nomination Deadlines

Nominations are now being accepted for the Section's Mary C. Lawton Outstanding Government Service Award.  The deadline for submitting a nomination is June 2, 2005.  The nomination for the Mary C. Lawton Outstanding Government Service Award should be based on outstanding contributions to the development, implementation, or improvement of administrative law and regulatory practice that reflects sustained excellence in performance.  All government lawyers active in the fields of Administrative Law and Regulatory/Agency practice are eligible. While career officials generally will be favored, exceptional political appointees also will be considered. All nominations should include the candidate's name and period of government service, the departments or agencies in which he or she has served and is currently serving, and the specific contributions of the nominee that you think warrant his or her selection. A successful package will include letters of support from others who are familiar with the candidate's government service. Submit your entry via email to Section Director Kim Knight at knightk@staff.abanet.org by June 2, 2005. The Lawton Committee is comprised of Cynthia Farina, Fred Emery, and Jodi Bernstein. Any of these individuals is available to answer questions about the Award. You may view a list of past award winners on the Section website: http://www.abanet.org/adminlaw/awardsprogram/home.html

Nominations are also being sought for the Section's Award for Scholarship in Administrative Law.  The Committee seeks the following desirable qualities in a written piece: publications that are well written, informative, and develop new ideas but not  difficult to read; tightly reasoned, with a clear analysis that does not detour from development of the main thesis of the argument; broadly applicable to at least several programs or issues; provide a new and timely insight into a current issue of administrative law; provide a new theoretical construct that will aid in the understanding or development of administrative law or develop a practical recommendation for solving a problem of administrative law; and contain a minimum of repetition of recitation of existing work.  Submit entries to Kim Knight at knightk@staff.abanet.org by June 2, 2005.  The Scholarship Committee is comprised of Dan Ortiz, David Frederick, and Dan Rodriguez.


Section Election Slate Announced

At the Spring 2005 Council Meeting the Nominating Committee suggested, and Section Chair Randolph May appointed Professor Richard W. Parker to fill the Section Council seat once held by the late Tom Sargentich. The Council unanimously approved Parker's appointment to complete the term, which has one year remaining.

The Nominating Committee has announced the slate of candidates for the Council 2005-2006 Election:

  • Section Chair:  Eleanor Kinney (automatic succession per the bylaws)
  • Section Chair-Elect: Daniel Troy (automatic succession per the bylaws)
  • Section Vice-Chair: Michael Asimow
  • Section Delegate: Judy Kaleta (re-nomination of the incumbent)
  • Section Budget Officer: Dan Cohen (re-nomination of the incumbent)
  • Section Secretary: James Conrad
  • Section Assistant Budget Officer: William Morrow
  • Council Member: Nina Olson
  • Council Member: Michael Herz
  • Council Member: Richard G. Stoll
  • Council Member: Hon. Ann Marshall Young
  • In accordance with the Section Bylaws, the Section membership shall vote upon the slate at the Section's Annual Meeting.  The election will be held on August 7, 2005 at 11:30am at the Fairmont Chicago.
