Many of the companies which were an integral part of the subprime lending industry have been forced into bankruptcy to restructure or liquidate.

This program focuses on the legal issues attendant in a bankruptcy case of a subprime lending industry debtor. Bankruptcy attorneys, as well as attorneys who advise lenders, investors, and others with a financial interest in the subprime lending industry, should listen to our distinguished panelists as they discuss the important issues involved in the bankruptcy of a subprime lending entity, including:
  • Unique Bankruptcy Code provisions, including safe harbor provisions related to the termination of a securities contract, the exercise of contractual terms related to repurchase agreements, and the automatic stay as it applies to security agreements
  • Issues related to preserving the going concern value, especially for the origination and servicing platforms, including termination and compensation issues for employees, resolution of contractual issues, and lender relationships
  • Issues related to warehouse lender relationships, including
    liability for buy-back obligations, consumer privacy issues, record retention policies and funding loans already in the consumer pipeline
  • Regulatory issues, including marketing practices, cease and
    desist orders, administrative proceedings, and license and bond forfeitures
  • First day issues, including use of cash collateral, debtor in possession financing, cash management and disposition of loans and other sales of property
