Description

State programs are the cutting edge of Brownfield cleanup and redevelopment of contaminated properties. As public and private markets engage in the opportunities afforded to states through Brownfield's law, states have developed new approaches to address the challenges and objectives of Brownfield cleanup.

By analyzing some of the different state programs that have been enacted, our expert panel provides you with a basic understanding of the process of Brownfield cleanup projects and the use and redevelopment of contaminated properties. Utilizing their experience, the panel demonstrates how to address issues such as risk allocation and management, best practices, and avoiding disputes. In addition, they discuss the disparity in needs of prospective buyers, prospective sellers, lenders, and insurance underwriters/brokers.

After reading the program material--which includes a comprehensive summary of the various state Brownfields laws along with a recent legislative update written by two practitioners--and listening to the audio program you should be able to:
  • Discuss the range of Brownfield issues pertinent to a redevelopment project
  • Analyze the regulatory and legal framework for a redevelopment case
  • Identify pitfalls to avoid when advising a client involved in a redevelopment project
  • Allocate risks -- including long-term residual risk management
  • Utilize Brownfields legislation to make otherwise unworkable deals and developments doable
