The FTC Franchise Rule: Analysis and Commentary is an analytical tool and comprehensive, practical guide for franchise law practitioners, including "old hands" and those who are new to the practice of franchise law. It serves not only as an important resource for understanding the provisions of the Amended Rule, but also places the changes effected by the recent amendments into perspective against previous federal, and current state, franchise regulation. This Monograph explains the changes brought about by the Amended Rule, promulgated by the Federal Trade Commission on January 22, 2007. While much of the Amended Rule will look familiar to practitioners who have been using the Uniform Franchise Offering Circular (UFOC) Guidelines, there are new provisions -- new disclosure requirements, timing provisions, exemptions, and prohibitions -- that practitioners will need to consider as they advise their clients. The FTC Franchise Rule examines the changes to the Rule, gives reasons for some of the more important changes, and offers practical tips practitioners may use in understanding and applying the Amended Rule.
