About this Book
Disability Discrimination Law, Evidence and Testimony explains and analyzes key aspects of disability discrimination law from several different perspectives to guide you through myriad federal and state statutes, court cases, and regulations. It covers employment, state and local government, public accommodations, telecommunications, housing and zoning, education, and criminal and civil institutions. Also included are detailed charts of relevant state statutory provisions and a history of disability discrimination law.
Part I offers a history of disability discrimination law and focuses on the deinstitutionalization of persons with mental and developmental disabilities; the disability rights movement that led to the passage of the ADA; and the exaggerated hope and frustration that followed.
Part II provides an overview of federal and state disability discrimination laws, and discusses how these statutes interrelate, as well as how sovereign immunity limits the effectiveness of the more comprehensive federal laws.
Parts III through V discuss similarities and differences amongst federal and state disability discrimination statutes as to their definitions of "disability" for eligibility purposes, their enforcement mechanisms and remedies, and the availability of attorneys' fees.
Part VI addresses practical ways to maximize the benefits of the client-lawyer relationship, including potentially divisive questions surrounding the need for accommodations and the ethical duties of lawyers to clients with disabilities.
Parts VII through XII focus on the major substantive areas of disability discrimination law: Employment; Public Services; Public Accommodations; Telecommunications and the Internet; Housing and Zoning; and Education.
Part XIII examines those disability discrimination law concepts and issues that are different or more prominent for persons with mental disabilities.
Part XIX discusses expert evidence and testimony in disability discrimination cases.
Appendices include charts of the statutory law in the 50 states and the District of Columbia governing employment, public services, public accommodations and housing; an alphabetical listing of U.S. Supreme Court decisions relevant to disability discrimination law; and brief summaries of each case, listed chronologically, and the page number(s) where it appears in the Reference Manual.
