This audio program reviews the Supreme Court's June 9, 2008 decision in Allison Engine Company, Inc. v. United States ex rel. Sanders, as well as current legislation pending in Congress to amend the False Claims Act. Allison Engine decided a number of important questions under the False Claims Act and raised others:- When does a subcontractor's false statement to a Government contractor give rise to potential FCA liability . . . and when does it not?
- What role does the Government's reliance on the subcontractor's representation play?
- What about the requirement that a claim be "paid by the Government?"
The Court's holdings on these issues have significant implications in health care fraud cases that the panel will examine.
On a parallel track is pending legislation to amend the FCA which, if enacted, would be a watershed event. To some, the legislation is a modest bill to correct many erroneous court interpretations that have narrowed the scope of the statute, and in particular its qui tam provisions. To others, the legislation is known as the "Whistleblowers Relief Act of 2008." This program reviews the more significant provisions in the House and Senate bills and discuss their potential significance.
